Criminal law ,also termed as Penal law, enforces government regulations to protect public safety and welfare. The law also includes decisions by appellate court. The decisions are basically the interpretation of the criminal law where clear law is absent. Substantive criminal law explains the procedure and punishment for crimes committed against the state. Enforcement of this law is the jurisdiction of the state.

In USA, the punishment is given with 5 objectives:

  • Retribution;
  • Deterrence;
  • Incapacitation;
  • Rehabilitation; and
  • Restitution.

There are limitations of punishment that can be imposed as suggested by the eight amendment of the constitution. Two elements are considered while delivering the punishment:-

  • Criminal intent; and
  • Overt criminal act.

Criminal activities conducted across international border makes the offender fall under International Criminal Law. International Criminal law is taken care of by United Nation.
